I'm not really sure this is true.  Even to the extent that it is,
exactly what constitutes "child pornog[r]aphy" varies from jurisdiction
to jurisdiction.

That's a nice theory, but it doesn't always match reality.  For
example, I'm assured there are jurisdictions where *purely textual*
pr0n describing sex involving a child (FWVO "child") is kiddy porn,
which totally fails your "by-product of a crime" test.
