Where in their terms of service does it specifically state they aren't? It's well-known that Google does business by 
studying the data to which they make no claim of ownership. That's how they provide their service, and such use is 
specifically allowed. Who could claim they didn't know that when they signed the contract?

You don't have to sell details of individual behavior to provide information about how a group operates. The analysis 
can be more valuable than the detail.

Most of the other stuff relating to legal but inappropriate uses is paranoia and overliteralism, in my opinion, but 
this goes to the heart of Google's business.
