Yes, and with continued effort, not least by the CSG/NACUA group that is working on this issue (perhaps with assistance from EDUCAUSE down the line?), more consistency may emerge, for Google as well as for other vendors of outsourcing products and services. We have a basic set of terms and conditions for software purchases and will try to get at least some of the language into contracts. I do not have much experience with Google, but in the past, large corporations have not been willing to generate institution-specific contracts and so I was wondering whether outsourcing student email to Google means accepting their terms. When I was there, in the interest of doing due diligence, I asked the (undergraduate) Helpdesk students to do a comparison of Live@edu vs Google and report their findings. Their response was quick: "We'll do it, but we can tell you the answer already. All of the students love and already use Google; we wouldn't even consider Microsoft." There's been a lot of discussion within the department about privacy and security but the general feeling remains that the standing contract is sufficient to protect privacy and Google resources will always be better at protecting security than what we could possibly provide. And the sense is that the recent Chinese episodes will only strengthen this environment.
