It's not a "nice try", it's *exactly the point*.  The reason the ACLU takes
cases like that is because the instant we *do* allow "unpopular classes",
we've torpedoed the "all Americans have a right" concept.

They certainly aren't working for Americans much these days.

Actually they are - if they can make sure that even the unpopular ones get
a fair shake, they help guarantee that we *all* do.
