Market choice works when there is choice.  My startup's new office is old industrial district close to a lower-income 
neighborhood.  I went looking for internet service and my _only_ choice is low-speed phone company DSL (they'll sell me 
higher speed, but the wiring is so cruddy that you get under 1.5 Mbps download.  And this is in Redwood City -- the 
middle of Silicon Valley!

4 miiles up the road in Palo Alto I have multiple providers spamming my doorknob and can get multi megabit service.  
But that class of service is apparently just for the swells.

Not regulation, but free market.  If customers find value in ISPs doing
this kind of DNS tampering, then those ISPs will prosper.  If customers
disapprove of the practice, they should *vote with their wallet* and
those ISPs should be shuttered as they run out of customers.
