Yes, I think we can all agree that the law is flawed.

Since you paid (subscribed to Live) Microsoft to perform the function (descibed in the EULA) you're complaining about, I'd say you're in a pretty weak position to use this as a test case to get the law changed.

If I paid someone to kick me in the nuts, my assault case against them would be somewhat weakened. Heck, if I hired someone to paint my house, and their contracts states that they reserve the right to occasionally kick me in the nuts while performing the service, then I'm still on somewhat shakey ground.
