IANAL, but it would be great if your company already has cast-in-stone AUPs for computer usage; eg no webmail of any kind, no spyware installation, yadda yadda, all activity will be monitored, etc. Sniffers and other tools must be complemented with realistic, enforceable policies to be effective. You probably have those policies in place, but it should be highlighted in the discussion. You wouldn't believe the number of times a linux notebook with the proper tools and equipment saved my butt; so build one if you can.
