To me, as big an issue as the original FUBAR is the alleged/reported failure of both MelIT and VGRS to respond and attempt to lessen the damage they had helped cause. I'm no lawyer, but believe under US laws such failure to mitigate is a factor in civil judgements -- if you choose to {say} just stand there and look stoopid rather than call 911 after you knock over the propane torch and start the house on fire....
