I see this as non-neutrality #NN in action. Neutrality should be linear pricing for each gigabyte (actually we should charge for gigabytes at all but that's a different issue). I argue any perverse pricing like this is a violation of neutrality principles. I would compare it to a 19th century railroad limiting how much wheat each farmer could ship and then increasing the price for the next batch. Just because they are rent-seekers in total control of the path.
