Evoked response (ER) has been in use for some time to evaluate
prototype commercials for TV, determine eyeglass prescriptions, etc.
The US Govt has funded ER research for use in polygraphy, however,
ER has not yet been found to be suitable for this application.

        On November 14, 2000 Dr. Farwell presented the Brain
        Fingerprinting results in a court hearing in Council
        Bluffs, Iowa. "Scientifically, we can conclude with a
        99.99% confidence that the critical details of the
        crime are not stored in Harrington's brain," said
        Dr. Farwell. "This is like finding that Harrington's
        fingerprints or DNA do not match the fingerprints or
        DNA found at the crime scene."

        The judge ruled, however, that Harrington's attorneys
        had failed to prove that this and other evidence probably
        would have changed the outcome of his original trial.
        Therefore Harrington's request for a new trial was denied.

Looks like the judge did not have 99.99% confidence!
