I suspect the defense attorney is grasping at straws.  He may be trying to
create a mess for the DOJ so they'll drop the charges.

government decides to prosecute...will you then say "insidious plot by

Perhaps you would prefer the government simply eavesdrop on the entire
'Net and proactively seek out spam cases? Just checking...
