IF disabling the NIC when the modem is connected is not easy to do, one could always require the user to not have the NIC connected when using the modem. This should be relatively easy to accomplish...simply have part of the modem startup process/login script/etc... try and contact an IP/host and make sure that target is [not] available through the modem path (for example if the modem is being used to dial into work, make sure the target site is unavailable via the company network)...if the client can contact the target, the user must have an alternate data path, and the connection via the modem should not be allowed in, so log the user and drop the connection.
