Actually scanning is more like walking down the hall at the hotel and trying the door handles to all the rooms looking 
for one left open.  That is someone showing an attempt to violate the room to do something not legal.  If a security 
person sees someone rattling door knobs like that, then they should arrest them.

Here is better analogy:
You call a hotel and question them about the services they offer to the
guests. Does the staff have the right to arrest or harass you? A port scan
is nothing more than a guest asking what services you offer.
