Absolutely correct. The details of one such approach are in Chris Soghoian, "Keep Your Data Safe at the Border," CNet,

So, you can use cloud computing or your own home server or whatever, and transfer it in encrypted form end-to-end.

Notice, though, that then we leave the border laptop debate and enter the FISA debate.  For communications between the 
U.S. and other countries, the "Terrorist Screening Program" and the versions of it authorized by the FISA update can 
subject those file transfers to surveillance.  And the NSA still has a good rep for breaking encryption when it puts 
its mind to it.

I am missing something. There is almost no where in the world when I can not find a wifi outlet usually free or low 
priced (if I look). So I transfer encrypted data from my home site when I arrive abroad, use it and send it back , 
again encrypted when I leave each country. IF it is not illegal to send encrypted files that should do the trick. What 
am I missing?

ps I am not in any way agreeing with the customs proceedures and chearly they will miss the real smart person .
