Subject: NY MTA To Ban Photography

The New York Metropolitan Transportation Authority board is in the process of banning, among other things, all photography within their NYC trains, busses, stations, and other facilities. The exception will be for members of the press who have been issued credentials by the NYPD. For details, see http://www.mta.nyc.ny.us/nyct/rules/proposed.htm .

From the NYC Transit Authority Rules of Conduct, part 1050.9(c):
Old language:
Photography, filming or video recording in any facility or conveyance is permitted except that ancillary equipment such as lights, reflectors or tripods may not be used. Members of the press holding valid identification issued by the New York City Police Department are hereby authorized to use necessary ancillary equipment. All photographic activity must be conducted in accordance with the provisions of this Part.

Pending language:
No photograph, film or video recording shall be made or taken on or in any conveyance or facility by any person, except members of the press holding valid press identification cards issued by the New York City Police Department or by others duly authorized in writing to engage in such activity by the authority.  All photographic activity must be conducted in accordance with the provisions of this Part.

The changes were proposed some time in May 2004. It appears that the notice of proposed changes has not yet been published in the New York State Register ( http://www.dos.state.ny.us/info/tocmain.html ) so the 45-day countdown clock is likely not yet ticking. Despite this, public comments are currently being accepted by a page accessible from the URL above.
