I'm not a lawyer either, but I studied constitutional law in school (my degree is in public policy) and I've written on this. There have been plenty of amnesties granted. I just looked it up and from very early in the republic this clause was determined not to apply to civil liability (Calder v. Bull, 3 U.S. (3 Dall.) 386) Larry Seltzer eWEEK.com Security Center Editor http://security.eweek.com/ http://blogs.pcmag.com/securitywatch/ Contributing Editor, PC Magazine larry.seltzer () ziffdavisenterprise com -----Original Message----- From: Alex Eckelberry [mailto:AlexE () sunbelt-software com] Sent: Wednesday, July 09, 2008 9:54 PM To: Larry Seltzer; Jacob Appelbaum; funsec () linuxbox org Subject: RE: [funsec] A Sad Day For America: Senate Approves Telco Immunity IANAL, etc., etc., but I believe a form of ex post facto is amnesty. I'm not sure Jacob was wrong here. -----Original Message----- From: funsec-bounces () linuxbox org [mailto:funsec-bounces () linuxbox org] On Behalf Of Larry Seltzer Sent: Wednesday, July 09, 2008 9:25 PM To: Jacob Appelbaum; funsec () linuxbox org Subject: Re: [funsec] A Sad Day For America: Senate Approves Telco Immunity
How is this not a text book example of an ex post factor Law?
Actually, it's the exact opposite of an ex-post facto law, which makes an act illegal after the fact. This law makes something legal, or at least removes civil liability, after the fact.
