The article's comparison to legal liability in cars and tires is illuminating. Windows 95 is now over 8 years old. If you used your car for 8 years until the brakes and tires were bald and then they failed, you'd have a pretty hard time suing the manufacturer. In fact, you'd be sued yourself for failing to keep your machine acceptably maintained.
You're forgetting something: When you bought your car the brakes and tires had no problem. If they had you probably would be able to sue the manufacturer and win. Over time brakes and tires deteriorate and there's nothing you or anyone else can do about it. Every physical object deteriorates over time. Windows and software do not deteriorate over time (ok, ok, Windows does :-) The problems you have in Windows were there since day 1, and so you can certainly blame the manufacturer for the bugs and/or bad design found in its software.
