Publication inside vs. outside the U.S. isn't so much the issue as is the
question of risk management for prospective business partners. Clearly even
the very largest partners whom one would necessarily expect to be the
best-suited to assume the risk of legal trouble over a worthwhile publishing
effort are choosing to err on the side of caution because the business
risk/reward equation has been destabilized by the U.S. Federal Government.

Those who participate in this endeavor are now exposing themselves to
potential jail time rather than the more benign risk of time spent in court,
in depositions, in meetings with attorneys, and then maybe in the poor house.

And, in a somewhat disturbing and ominous twist, it may be the case that
companies who expect to benefit financially from successful prosecutions under
the DMCA and similar legislation are now opting out of anything resembling
support for the activities that they anticipate will be part of future
prosecutions.
