Is Microsoft being hurt by opensource products enough that they are
resorting to these scare tactics? I know there has been a lot of
publicity over firefox and such but I would be actually surprised if it
was hurting MS enough to notice.

"283 software patents not yet reviewed by the courts" is what they
say.  I don't see their list visible either.

I think "not yet reviewed by the courts" is presumably a euphemism for
"not yet challenged".  If they are using their terms correctly
and these are issued patents, someone somewhere must have a list.
And they've been declared legitimate - it's not like an unissued patent
where even the USPTO hasn't legitimized it with a number.
