IT's a hard decision: you can't be sure that the employee copied company's files
in his personal laptop.

I think you should check two things:
a) Does your contract with this employee has a clause that indicates if he can
bring his laptop to the office, or the procedure in the case of dimission/firing?
if the contract states that you shouldn't bring your personal computer to the
office, you could wipe it. If the contract states that in case of quiting/getting
fired user is not allowed to return to his desk, and that any personal stuff
would be returned after revission, you could also do the same.
b) is there any local law (you should check with your Legal Dept or any lawyer
that advices you)  that allows to do such thing? 

What you Shouldn't do, is reviewing the laptop: even logging in, or using another
OS to check the files that the user could have written, because that's private
stuff.....

Hey all,
Needed some advice on a corporate policy issue.  If an employee has a
personal laptop in the office, and that employee is terminated in the
process of a merger, can the company wipe the hard drive of the
personal computer before it's returned to that employee?  Here's the
scenario:

Our company is going through a merger, and through the rounds of
"integration" of the two companies, employees that are let go from the
IT department are escorted out of the building immediately, and not
allowed to return. Their manager packs up their personal affects and
ships it to them.  In one case, the employee had some personal laptops
in their office, and wants them back (obviously).  Are we allowed to
wipe the hard drive of that personal laptop before giving it back to
the employee?

I'm trying to determine if this is even legal or not, so I'm not sure
where to look for advice.
