Really, I was addressing what a lot of attorneys do to confuse and
confound juries and judges and preserve an issue on appeal, i.e.,
challenging the credibility of the evidence through the individual
collecting and manner it was collected. The more the technology
involved the harder an attorney will work to discredit it. Technical
evidence is hard to present and harder for juries to absorb. And if
the attorney's done is job and laid enough ground work, (primarily
claims of manufacture or non-preservation [are there any other?] by
the IT guy) juries will simply ignore the evidence.
