I don't think that would be considered communication with them... 
that shouldn't be your concern.  The potential problem is the gov't
would have the opportunity to snoop on your traffic too and you would
have to "trust" that they aren't.

 Beyond the fact that probably 80%-90% of all internet broadcasts would contain little to no useful data top 
incriminate someone, this still could be an issue. Say for example, I am connected to the internet through the same 
broadband ISP as someone that is being "tapped". Now this person is receiving broadcast messages from myself, for DNS 
items and so on. Will my broadcasts count as communication with this person?

This was just a dumb thought I had when reading the posting.
