My personal feeling is that if you weren't doing something that is illegal in the first place (hacking is now illegal in the US - it is considered a terrorist act and carries hefty penalties), you would not be wandering around in my honeynet. Sure, I may have to see you in court, but it will be civil court. Our litigation process is starting to turn. People are taking the stance that if you were doing something wrong/dumb, then what happened to you is your own fault. Since most of the cases are tried before a jury, I'll take my chances. You, on the other hand, will be going to jail because in order to sue me you must admit that you hacked my system.
As an additional protection, I have a disclaimer posted for any log in attempt -
NOTICE - THIS IS A PROPRIETARY SYSTEM. ALL LOG INS, ACCESS, AND USAGE WILL BE MONITORED
That's all it takes to cover me legally in the USA. Not sure about other places.
