Um, the SCOTUS decision says no such thing exists in the USA (or, let
us be precise, existed at the time).  This is a very different thing
from not understanding the concept; if they didn't understand the
concept they couldn't have said anything coherent about it at all.

Right, and if it doesn't exist, that would explain why I don't understand
the non-existent thing.  Which is what I said. ;)
