How hard would it be to prove that an ISP had rate limited your
business into extinction? I don't think there would be anything to prove, the telcos wouldn't be hiding the fact. They would use theie superior service as a marketing factor. Alternatively they could negotiate "quality fees" from alternate providers. It might make sense for Vonage, for instance, to pay Verizon or Comcast to get neutral treatment.
I am assuming that even if the bill doesnt pass, monopolistic
practices would still be illegal, of course getting your hands on their logs/config files might be a bit hard. Yes, that would be the alternative.
