The reason you have a First Amendment, is that you didn't get it right first time around. We've had freedom of speech in the UK since deep in the mists of time. It's the law in the UK, that you mustn't speculate on the facts of a trial, in advance of the trial, because that leads to an unfair trial. So, for example, when the Home Secretary said "We've caught the main plotters", he was skating on *very* thin ice. He should have said "We have arrested several people who are alleged to be plotting ..." You can't say "The were plotting to blow up" because that's assuming their guilt, and in the UK, there's a presumption of innocence until proven guilty in a court of law. Newspapers can't assume guilt. Surely you have a similar law in the USA? On Tue, 29 Aug 2006 rms () bsf-llc com wrote:

"On advice of legal counsel, this article is unavailable to readers of nytimes.com in Britain," is the message they would have seen. "This arises from the requirement in British law that prohibits publication of prejudicial information about the defendants prior to trial." In adapting technology intended for targeted advertising to keep the article out of Britain, The Times addressed one of the concerns of news organizations publishing online: how to avoid running afoul of local publishing laws. "I think we have to take every case on its own facts," said George Freeman, vice president and assistant general counsel of The New York Times Company. "But we're dealing with a country that, while it doesn't have a First Amendment, it does have a free press, and it's our position that we ought to respect that country's laws." ... _______________________________________________ Fun and Misc security discussion for OT posts. https://linuxbox.org/cgi-bin/mailman/listinfo/funsec Note: funsec is a public and open mailing list.
