Ok, I'm confused, or maybe not... So lets say in a publicly archived e-mail list that the patent office reads every day, I mention an idea for a new and great widget. Later today I decide that my idea is truly unique and I want to spend the money (couple thousand USD basically) to get a patent for it. I would be denied that patent just because I mentioned the idea publicly? Even though it was truely my idea, I would still be denied the patent? Mike B Michael P. OK, got it. So, I can't patent it, but anyone else can. Rats.
You could apply for a patent for it and so long as the patent examiner did not find your publication, a patent could be granted, but if someone else then challenged that patent on the grounds that you, the applicant, had previsouly published the idea, I strongly suspect that the patent would be revoked much more easily than if someone else had filed the application and _you_ challenged their patent. Yes, it's seriously borked...
