Yes, that's program's that decide to put your NIC into promicious mode.
And is it correct that without "tcpcump", the network is not in promiscuous mode?
Depend's on what programs are running on your box. Under linux you can watch to you /var/log/messages to see kernel messages show you when your box enter, or leave promicious mode.
