know the best translation for some terms (IANAL), so if you know better,

Stellungnahme zu den Verfassungsbeschwerden
gegen den Großen Lauschangriff


Am 1. Juli 2003 findet beim Bundesverfassungsgericht die mündliche
Verhandlung zu den Verfassungsbeschwerden gegen den so genannten Großen
Lauschangriff statt. Beim Großen Lauschangriff kann die Polizei
Gespräche in Privatwohnungen mit Hilfe von Wanzen abhören. In einer
Stellungnahme zu den Verfassungsbeschwerden kommt das Unabhängige
Landeszentrum für Datenschutz Schleswig-Holstein gemeinsam mit mehreren
anderen Datenschutzbeauftragten zu dem Ergebnis, dass die Regelungen zum
Großen Lauschangriff verfassungswidrig sind. Dies folge aus einer ganzen
Reihe von Erwägungen. So liege sowohl ein Verstoß gegen die
Menschenwürde als auch gegen den Kerngehalt des allgemeinen
Persönlichkeitsrechts und des Schutzes der Unverletzlichkeit der Wohnung
vor. Die Belauschung von Gesprächen selbst aus der Intimsphäre von
Eheleuten verstoße außerdem gegen den grundrechtlichen Schutz der Ehe.


Auch die Ausgestaltung des Großen Lauschangriffs auf gesetzlicher Ebene
sei in mehrfacher Hinsicht verfassungswidrig. Die Erforderlichkeit für
die Bekämpfung der Organisierten Kriminalität sei nicht durch eine
objektive Rechtstatsachenanalyse belegt. Einer solchen Analyse hätte es
umso mehr bedurft, als erst kurz zuvor in den Jahren 1992 und 1994
umfangreiche Gesetzesverschärfungen mit dieser Zielsetzung eingeführt
worden sind, deren Effizienz niemand überprüft habe. Der
Straftatenkatalog für die Durchführung von Großen Lauschangriffen gehe
weit über die Organisierte Kriminalität hinaus. Der Schutz der
strafprozessualen Aussage und Zeugnisverweigerungsrechte sei völlig
unzureichend. Die permanente Verlängerung von Großen Lauschangriffen sei
ohne große Hürde möglich. Die Betroffenen würden auch im Nachhinein nur
unzureichend, in vielen Fällen gar nicht unterrichtet. Die Zweckbindung
der Daten sei lückenhaft.

Der erste Erfahrungsbericht der Bundesregierung zum Großen Lauschangriff
belege eindrucksvoll, dass das Instrument bislang überwiegend zur
Bekämpfung von Betäubungsmittel und Tötungsdelikten eingesetzt worden
ist. Der Bezug zur Organisierten Kriminalität konnte nicht hergestellt
werden. In 58% der Fälle hat das Abhören überhaupt keine Erkenntnisse
für das jeweilige Ermittlungsverfahren erbracht. Daraus sei der Schluss
zu ziehen, dass der Große Lauschangriff nicht wirklich erforderlich sei
und bislang auch nur mäßige Erfolge gebracht habe. Dies rechtfertige
nicht die Aushöhlung fundamentaler Grundrechte von der letztendlich
jeder in Deutschland betroffen sein kann.

Opinion regarding the commencement of action at the German
Constitutional Court against the "Big Eavesdropping Attack"

On July, 1st 2003 there will be a Constitutional Court hearing about the
claims against the so-called "Big Eavesdropping Attack" (Grosser
Lauschangriff). If such an attack is allowed, police can install bugs in
private residences to eavesdrop the communications. In a joint statement
about the commencement of action the ULD (Independent County Bureau for Data
Privacy, Schleswig-Holstein), together with several Data Protection Officers,
comes to the conclusion that the regulations regarding the "Big Eavesdropping
Attack" are unconstitutional. This would immediately follow out of a series
of considerations. Firstly, there is a clear breach of Human Dignity that is
guaranteed in the UCHR and the German Constitution, too. Furthermore the core
of the constitutionally guaranteed right of the "sanctities of one's home"
were violated. Eavesdropping private communications, and even that of married
people, also breaches the constituonal guarantee of the superior protection
of the marital status.

Also, the design of the "Big Eavesdropping Attack" on the legislative level
was in many directions unconstitutional. The said requirement to fight
"organized crime" is not confirmed by any "law actuality analysis" (Rechts
Tatsachen Analyse). Such an analysis would have been required especially
because only in 1992 and 1994 there were accentuations of laws in that area,
which have yet to be verified efficiency-wise by anyone. The catalogue of
felonies giving reason for starting a "Big Eavesdropping Attack" lists far
more than just felonies being part of the organized crime. The protection of
one's right in in-court statements and the right to refuse to give evidence
are completely insufficient. The permanent prolongation of an eavesdropping
would be possible for the law-enforcing agencies without any obstacles. The
persons involved in the eavesdropping would be informed afterwards --
insifficiently, in many cases not at all. And finally the predetermnation of
the resulting data of an investigation for a specific purpose was patchy,
too.

The first report of the Federal Government about the "Big Eavesdropping
Attack" would impress before all with the statement that the instrument until
now was mostly used in cases of violation of the drug or homicide laws. A
relation to the organized crime could not be liaised. In 58 percent of the
cases the wiretapping or eavesdropping did not result in any insights at all
for the prosecution in question. As a consequence everyone should agree that
the "Big Eavesdropping Attack" is not really necessary, since it did not
bring any prosperities for the criminal prosecution. It would in no case
justify the undermining of fundamental rights, which everyone in Germany
would possibly have to suffer from.
