FC: Where have all the good names gone? Dupont grabs science.info

[Preregistration ("sunrise period") lets trademark holders snatch up domain names before the general public. Of course only firms that actually own trademarks are supposed to be participating. I'll forward any response from DuPont. --Declan]

Dear Ms. Galbrith:

This message is to follow-up the telephone message.

I am the director of Consumer.net and the owner the Science.net. I am
contacting you concerning your registration of the domain name SCIENCE.info
which was registered during the Sunrise Period for trademark holders.

In the application you submitted the trademark number is "0" and the date of
trademark is "0200-01-03." This information is clearly invalid. I also
searched the www.USPTO.gov trademark database and I was unable to find a
trademark for "SCIENCE" registered to the du Pont Company.

Please identify the trademark used to register SCIENCE.info during the .info
Sunrise period.

Thank You,

Russ Smith

The taken .info domains are queued up for the Sunrise period for
Tucows only. This means the list of (soon to be) taken domains
under the .info Sunrise does not even included queued orders for
all the other registrars in addition to Tucows. Tucows is not
taking landrush applications for these domains since there is no
hope of the domains ever reaching the Landrush stage.

Some domains already queued for Sunrise registration:
"consumer.info", "privacy.info" "music.info" "pets.info"
"movies.info." I have checked only a very small sample but I would
say very roughly 80% or more of good generic .info domains are
already queued up for registration during Sunrise.

Looks like there won't be many good .info domains left after the
trademark holders get their pick during the "Sunrise" period.
There is no whois yet but initial registration applications are
being accepted for the "Landrush" period. When these initial
registrations are made the response is "Domain Taken" if it was
already registered under Sunrise.

The first 2 I tried, "consumer.info" and "privacy.info" were
already taken under Sunrise by owners of trademarks on "privacy"
and "consumer." Most likely the trademarks were for some type of
artwork containing the word. This loophole in the .info "Sunrise"
rules approved by ICANN allows generic domains to be taken before
the public has a chance.

http://www.icann.org/tlds/agreements/info/registry-agmt-appj-11may01.htm

"In order for trademark and service mark owners to qualify to
receive a registration during the Sunrise Period (a "Sunrise
Registration"), the following information must be provided to
Registry Operator: (i) the ASCII characters name of the trademark
or service mark; (ii) the date the registration issued; (iii) the
country of registration; and (iv) the registration number."

The loophole is that trademarks are often not issues based on
"ASCII characters name of the trademark or service mark" but are
based on artwork that happens to contain a generic term.
