I think you refer to the finding (file number 1 Ws 152/04 of 05/01/10) by OLG Karlsruhe and the legal problems when automatically filtering and deleting spam mails adressed to correct recipients.

If you accept any eMail to any recipient and only deliver to the valid recipient and delete all other mails without noticing the original sender, this shouln't be illegal - even in germany :) It only might be illegal, if the recipient is valid.
