Should such a thing really be illegal, under any circumstances? If you take good care of your system(s), you should not be worried about a simple port scan. I, for one, maintain a defaced Web site archive. I run an OS fingerprint to deterine the OS for inclusion within the archive. Should I be thrown in jail for this?
