a query re "call recording" on skype

I have an application which automatically starts recordin when I make  
a connection using Skype (it also  does it for iChat  etc.). Does this  
violate the various anti-telephone recording laws even though often  
how it person is connected to is not clear. For instance is a Skype to  
Skype connection a telephone call?
