Subject: Tough break, Brett (and the rest of us)

Hello All:

I have written a summary of Pacific Bell Telephone Co., v. Linkline Communications, Inc., slip op. 555 U.S. ___ (rel. Feb. 25, 1009); http://www.supremecourtus.gov/opinions/08pdf/07-512.pdf on my blog: http://telefrieden.blogspot.com/.

The entire Court seems to think that incumbent carriers, such as Pacific Bell, have no antitrust duty to deal with rivals, based in large part of the FCC's determination that "robust" facilities-based competition exists. The Court states that "“DSL now faces robust competition from cable companies and wireless and satellite services.”
