How many would-be foreign grad-students see the requirements to get a student visa, the limitations on their ability to come and go, and the imposition of limitations on areas of study and conclude that it's not worth the trouble? The horror stories have been documented widely, including on this list, and it's no wonder "the best and the brightest" are going elsewhere. After all, it's a Free Market out there and "the best and the brightest" are simply voting with their feet.
