I thought that the FCC order on CALEA compliance already mandates that all IPS make traffic accessible to eavesdropping by Federal law enforcement authorities.

Many universities have worried about their status for compliance with CALEA and the need to have aggregate spanning taps for all traffic to be seen by law enforcement. Since you don’t know if it’s VoIP until you inspect that data flow (usually RTP or SRTP inside a UDP and IP carrier), the FCC application of CALEA seems to require that all traffic must be available for law enforcement surveillance.

If this is the case, and I’m a rusty on it and may be wrong, then the national debate may have already occurred without the serious discourse that the issue merits.
