It seems to me it does more to CYA of those trafficing in medical data than it does to guard the patient's privacy. Doesn't it have a large "marketing" loophole inserted late in the game by the pharmacutical lobby? I note the NYT just had a lead story <http://www.nytimes.com/2008/02/24/health/24dna.html?ref=health> on people who lie to their physicians for fear their insurance will be cancelled.
