I would be interested in someone pointing out the exact section of the US Code under which the NY Times might be prosecuted so we can all look at it instead of further speculation on the issue.

My current understanding is that treason requires action with knowledge and intent to cause harm to the country. It would seem difficult to make that case about the NY Times incident. If anything, they could claim they were trying to protect the Constitution by their disclosure. However, I am always willing to learn something new!
