Loveless said he believes that since the attacks were mostly carried while the plane was over international waters that U.S. law enforcement might have a hard time making the case that he was violating any laws. The real answer to that very interesting question, he said, would probably not be evident until someone gets sued in court for it.
There's a very extensive body of caselaw, US and otherwise, holding that air and sea vessels are effectively the sovereign territory of the country from which they originate / in which they are registered, for the purposes of law enforcement when it comes to international waters and airspace. E.g., you can't avoid U.S. prosecution for murder by waiting until you're outside U.S. airspace or waters to kill someone on a U.S Airways flight or a Carnival Cruise ship.
