Dear Dave:

You were kind enough to post my last article, about bringing new
technologies to all Americans, on InternestingPeople.  

I thought you might be interested in a short article by me and Dr. Wayne
Leighton, just published in Catholic University's CommLaw Conspectus.
It's titled "The Law of Property and the Law of Spectrum:  A Critical
Comparison." 

The article tries to cast some light on the heated debate between
socialistic advocates of "The People's Airwaves" and the capitalist
advocates of Radio Spectrum Property Rights.  The article notes that
"private" property in the US has always had lots of regulation, and that
the supposedly socialized airwaves have always had many aspects of
private property.  The point?  Making the best use of the spectrum will
not be as simple as slogans hint.  Property rights are the best model or
"default setting" for spectrum use, but property rights are very
complicated and require much government enforcement.  Also, a
significant amount of spectrum will have to remain outside the market,
to be used as commons or parks.
