The Open Source Initiative has a strict definition of what can be called "Open Source"[1]. They have also registered a certification mark relating to Open Source that has legal implications if people misuse it. A quick survey of the definition will show that asserting trade secret rights over the code, would not be considered open source. Furthermore, if GaDuGi does use portions of Linux, then they're up for a nightmare with the distribution because of Linux's licensing under the GPL. While they might be able to get away with this inside the Cherokee Nation (a questionable practice at best), distribution of this illegal software in the good ol' US of A will face snares to say the least.
