This was part of the settlement that allowed ReplayTV's current owners to avoid the lawsuit that killed the original company through litigation costs. I was part of the EFF lawsuit (Newark v. Turner) that was joined into the 28 media companies against ReplayTV. We were in that suit specifically to establish apersonal right to space shifting and commercial advance.The suit was settled, so we were unable to pursue a conclusion.
