Dear Dave:

Hope all is well with you, wife and family.

I was just told about a "stealth" provision that has been included to the Internet Tax Freedom Act (S 150) that may threaten the future openness of the Net. It also has implications for privacy, law enforcement, and universal service.

The provision added to the bill defines Internet access as exempt of all common carrier safeguards. Internet access becomes a Title I service; such a provision removes the critical non-discriminatory safeguards that have been an essential part of the Internet's character.

This is moving quickly and has already passed the House. It appears Sen. Allen from Virg. is involved. Chris Murray of Consumers Union has more information (202-462-6262). Earthlink is also opposed to this change, I am told.
