Diebold will not sue for copyright infringement in memos...

In a surprising development (via Larry Lessig[1]), Diebold has filed a
memorandum[2] with the San Jose Federal court in which they state:

[...] Diebold, having issued notifications in good faith compliance
with the DMCA, has decided not to take the additional step of suing
for copyright infringement for the materials at issue. Given the
widespread availability of the stolen materials, Diebold has further
decided to withdraw its existing DMCA notifications and not issue
further ones for those materials.

This means I'll be mirroring Ping's archive here[3].

If you find yourself wondering to what use the content of the memos
has been put, see the following three documents that Jim March[4] has
filed with the CA Secretary of State that each use material obtained
from the memo archive to take Diebold to task: [5], [6] and [7].

This information was likely persuasive in the CA Secretary of State's
mandate[8] last Friday of voter-verified paper audit trail (VVPAT) and
what appears to be the first open source mandate ever from American
government.
