The problem, of course, is that Yahoo has in fact a physical presence (and
assets) in France which a French court can seize based on THEIR interpretation
of THEIR laws.

This whole "nexus" issue is, of course, the big sticking point as well on
Internet sales taxation... whose laws, taxes, etc apply?  This is especially
sticky as (in this case) where you're dealing with something that crosses
international (and not just state) boundaries and where there are even multiple
companies involved... ISPs, backbone providers, Web hosting companies, and on
and on... and it's not even always clear "who to sue".

I think it IS interesting, though, that this is an area where big, multinational corporations (like Yahoo) have a natural DISADVANTAGE compared to small, local
operators... in that the big guys have physical presence under multiple
jurisdictions, and therefore subject themselves to a far more discouraging
assortment of (sometimes mutually exclusive) laws governing their operations.
