Pack San Jose, CA, Courtroom July 12

Silicon Valley EFF members urged to support Matthew Pavlovich by attending
his appeal hearing in DVD/DeCSS case

(Issued: July 11, 2001 / Deadline: July 12, 2001)

Introduction:

   Movie industry trade group DVD-CCA has filed suit against hundreds of
   individuals all over the world, alleging that the DeCSS software
   (which decodes DVD discs, enabling them to be played on Linux
   computers) constitutes a violation of Calif. trade secret law. While
   EFF does not believe that the case has merit, it has caused a lot of
   hardship to the defendants, all of whom are expected to defend
   themselves in a Calif. court room, which for most of them is very far
   from where they live and work.

   The state supreme court has ordered an appellate rehearing of the
   jurisdictional issue, and one defendant, Indiana student Matthew
   Pavlovich, has filed a renewed motion to dismiss the case against him
   with the appellate court, with a hearing scheduled for tomorrow
   morning.

   EFF has a strong belief that packing the court room helps ensure
   careful judicial review of the issues raised, and we have used this
   tactic to good effect on a number of occasions.

What YOU Can Do Now:

   EFF's northern California supportes who wish to show solidarity with
   the DVD case defendants in their efforts to have the case against them
   dismissed should show up at the California Appellate Court at 333 W.
   Santa Clara St., 10th floor, in San Jose, at approximately 9 a.m.,
   Thu., July 12.

   The court hearing will begin at 9:30 a.m. sharp, and could last
   several hours.
