                Crime Prevention Act of 1995 (Introduced in the Senate)


                        TITLE XV -- Internet Gambling


SEC. 1501. AMENDMENT OF TITLE 18 WITH RESPECT TO TRANSMISSION OF WAGERING
INFORMATION.


Section 1084 of title 18, United States Code, is amended --


(1) in subsection (a) --


(A) by striking '(a) Whoever' and inserting '(a)(1) Whoever';


(B) by striking 'wire communication' each place it appears and inserting
'wire or electronic communication';


(C) by striking 'on any sporting event or contest';
and


(D) by adding at the end the following new paragraph:


"(2) Whoever being engaged in betting or wagering knowingly uses a wire or
electronic communication facility for the transmission in interstate or
foreign commerce of bets or wagers of information assisting in the
placing of bets or wagers, or for the transmission of a wire or
electronic communication which entitles the recipient to receive money or
credit as a result of bets or wagers, shall be fined not more than $5,000
or imprisoned not more than 1 year, or both.";


(2) by redesignating subsection (e) as subsection (f);
and


(3) by inserting after subsection (d) the following new subsection:


"(e)(1) Notwithstanding any provision of Federal or State law, in
imposing sentence on a defendant for a conviction of a violation of this
section, the court shall order that the defendant forfeit to the United
States any property, real or personal (including hardware and software).
involved in the offense, and any property traceable to gross profits or
other proceeds obtained from the offense.


"(2) Proceeds from property forfeited under paragraph (1) shall be
deposited in an account of the Department of Justice.".
