There's a difference between having a right to not say anything or maintain your secrets, or even live in seclusion, and the expectation to have it where it doesn't exist. Looking to the US constitution, all these arguments about privacy can be taken from the 5th Amendment. In the States you have a right to remain silent and it should not indicate guilt. This is an old philosophical debate with good arguments on both sides. Re-arguing it is always good -- especially in a society such as that of the US where it is a right held sacrosanct. But it is simply moot in the case of privacy - as the issues today are on whether it even exists or can be expected to exist under certain conditions.
