Wires look crossed here: Using someone else's SSN is not identify
theft. But using someone else's name is. Keep in mind SSNs are unique,
names are not.


In this case, I assume the problem was a lack of a clear identity to attribute attacks to.  The law has a long history 
of penalizing illegal behavior more when you visibly attempt to avoid consequences.
