on the account creation page, isn't there also an option (defaulting to OFF) 
that you can select to enable the subscription to the mailing list? maybe it is 
defaulting to on and needs to be more visible? either way, IMHO, it should 
default to OFF and be more visible...

NOTE: i haven't seen the new sign-up stuff in (10+?) years...
